Judicial Boards

Student Tribunal

Duties of Student Tribunal:

  • Interpret the KSU SGA Constitution, By-Laws and legislation, upon written request by the Student Body President, Chair of Student Senate, or by presentation of a petition signed by 50 members of the KSU SGA. The interpretation should be (in order of priority):
    • Based primarily on the common understanding of the words and phrases.
    • Logically consistent with the remainder of the document.
    • Consistent with prior interpretations.
    • In the best interest of members of the KSU SGA.
  • Try bills of impeachment passed by Student Senate, with the exception of judicial boards.
  • Hear appeals of decisions form the Housing and Dining Services Judicial Boards, ad hoc boards, SGA Elections Committee, and Student Review Board, with the authority to modify or overturn the decisions of such judicial boards.
  • Hear in the first instance disciplinary cases involving special circumstances or situations for which jurisdiction is not otherwise described.
  • Consider appeals of decisions originating under the Policy Prohibiting Sexual Harassment, Policy Prohibiting Sexual Violence, and Policy Prohibiting Racial or Ethnic Harassment when appeal is beyond the administrative process desired.
  • Hear appeals from any committee created according to the legislative powers granted in Article V of the SGA Constitution when legislation specifies such an appeal.

Student Tribunal shall be composed of two faculty members appointed by Faculty Senate and five students appointed by the Student Body President in consultation with the Attorney General, as follows:

  • One off-campus student unaffiliated with an organized living group.
  • One student from a Fraternity or Sorority which is a member of The Interfraternity Council, Panhellenic Council or Black Panhellenic Council.
  • One student from the KSU Association of Residence Halls (KSUARH).
  • Two at-large students, one being designated as Chancellor.

Housing and Dining Services Judicial Boards

Duties of the Housing and Dining Services Judicial Boards:

  • Hears cases involving violations of the Conduct Code, Jardine policies, Residence Halls Policy and Information Handbook, and Housing and Dining Services leases and contracts.
  • Hears all cases involving violations of such rules occurring on the premises of such living group by an non-resident and shall hear all cases involving violations of such rules on grounds surrounding living group premises and in buildings and areas used in common by living groups, such as dining areas.
  • Assembles hearing panels for judicial proceedings.

The Housing and Dining Services Judicial Boards shall consist of the following:

  • Chief Justices are selected among students in good academic standing living in the residence halls or Jardine by a process outlined in Constitutions from Jardine and each residence hall or Strong Complex specified in the By-Laws.
  • Associate Justices from each hall or Strong Complex and Jardine who are selected from students in good academic standing living within the residence halls or Jardine according to the Jardine and Hall/Complex Constitutions.
  • A hearing panel shall be assembled by the Housing and Dining Services Judicial Board, and consist of:
    • A Chief Justice.
    • A minimum of four (4) and a maximum of six (6) Associate Justices. The majority of the justices must come from the hall, or Strong Complex, in which the complaint originated. Exceptions must be approved by the Attorney General before the hearing begins.
    • A Residence Life Coordinator (RLC), or Assistant Residence Life Coordinator (ARLC) or designee, as Advisor to the panel.
    • Other advisors as deemed necessary by the Advisor in consultation with the Chief Justice

Student Review Board

Student Review Board hears cases involving violations of the Conduct Code occurring on campus or at off-campus university sponsored events.

Student Review Board in composed of one faculty member selected by Faculty Senate and five students appointed by the Student Body President, one being designated as Chair, as follows:

  • One off-campus student unaffiliated with an organized living group.
  • One student from a Fraternity or Sorority which is a member of Interfraternity Council, Panhellenic Council or Black Panhellenic Council.
  • One student from the KSU Association of Residence Halls (KSUARH).
  • Two at-large students.

Parking Citations Appeals Board

Duties of Parking Citations Appeals Board:

  • Consider and respond to student, faculty and staff appeals of Kansas State University Parking Services parking citations.

Parking Citations Appeals Board consists of eleven (11) members, six being students, three being faculty, two being classified staff as follows:

  • One off-campus student unaffiliated with an organized living group.
  • One student from a Fraternity or Sorority which is a member of the Interfraternity Council, Panhellenic Council or Black Panhellenic Council.
  • One student from the KSU Association of Residence Halls (KSUARH).
  • Three at-large students.
  • Three faculty members.
  • Two classified staff members.

Judicial Council

Duties of Judicial Council:

  • To serve as designee of the Attorney General when deemed necessary.
  • To receive and dispose of complaints filed with the Attorney General and Student Tribunal.
  • To prepare and distribute pamphlets, materials and programming information explaining the SGA judicial system to all members of the university community.
  • To provide information and forms to the judicial boards necessary to their administration.

Judicial Council is composed of the Dean of Student Life or designee, the SGA Attorney General who serves as Chair, and five students as follows:

  • One student appointed by the President of KSU Association of Residence Halls (KSUARH).
  • One student from a Fraternity or Sorority appointed by the Presidents of the Interfraternity/Panhellenic Councils and Black Panhellenic Council.
  • One student unaffiliated with an organized living group appointed by the Student Body President.
  • One Student Senator appointed jointly by the Chair of Student Senate and the Chair of the Senate Operations Standing Committee.
  • One at-large student appointed by the Student Body President.

Ad Hoc Boards

Duties of Ad Hoc Boards:

  • Ad Hoc Boards are appointed by the Dean of Student Life, or designee, after consultation with the SGA Attorney General, during periods when judicial board members are unavailable or as the need arises.
  • Ad Hoc Boards can hear all types of complaints/cases, as long as they fall within the jurisdiction of the KSU SGA Judicial Branch.

An Ad Hoc Board is composed of two students and one faculty-staff member, preferably with prior judicial experience.
