Off-Campus Housing Support
As a K-State student, you have access to the free services provided by the office of Off-Campus Housing Support. Off-Campus Housing Support provides information about the rights and responsibilities of tenants and landlords to Kansas State University students. Common issues include maintenance, security deposits, lease reviews, and more. If you have questions about these or other off-campus housing issues, make an appointment to meet with the director.
The Covid 19 pandemic has caused a great deal of uncertainty and upheaval in all aspects of college life and apartment/house leases are no exception. Unless other factors are present, classes being transitioned to on-line learning is not a basis for termination of a rental agreement. Landlords and tenants can agree, however, to modify a lease to take into consideration unknown or unexpected impacts of the pandemic. This modification MUST be in writing and is known as an “addendum”.
A sample addendum is posted below. Please note that the language in paragraph 2 is very one-sided in favor of the tenant; not many landlords would likely agree to its terms. The landlord and tenant can negotiate the terms of paragraph two. For example: perhaps the landlord would agree to 30 day notice of termination and payment of ½ of the rent; or lease would be terminated at the 6 month mark of the lease with rent being paid until that time; or some other compromise.
The main thing to remember is that a written contract such as a lease cannot be modified orally; it must be modified in writing. It is not legally binding if a landlord tells you they will let you out of the lease if classes are transitioned to on-line learning. That promise must be made in writing.
