Court sides with university and dismisses former employee's lawsuit

Siding with Kansas State University, a court has dismissed a former employee's lawsuit.

On May 29, the U.S. Court of Appeals for the 10th Circuit affirmed the earlier dismissal of a lawsuit filed by Grace Hwang, a former assistant professor. Hwang claimed that the university discriminated and retaliated against her after she chose to accept long-term disability benefits following a prolonged illness. The court determined that, even if Hwang's factual allegations were true, the university did not discriminate or retaliate against her, but instead accommodated her difficult circumstances appropriately.

"There was no substance to these claims against the university, and the court recognized that," said Peter Paukstelis, Kansas State University associate general counsel.
