  • There were no announcements.

GENERAL BUSINESS:

  • Chair Norris opened discussions on the elections regulations bill.
    • There was one change after Thursday’s meeting regarding the definition of
      harassment.
    • There was one item of concern regarding contested elections.
      • Coordinator Spencer believes contested elections should go
        through the regular review process.
      • Bill Harlan has been working on seeking a resolution.
        • All students qualified to vote can contest an election.
        • They can do so by filing a complaint within 24 hours of the announcement of the results.
        • The complaint must allege that the violation put the election results in doubt.
        • The suspected violation may have been discovered at anytime during the election.
        • There was discussion about whether the complaint would be new or could be previously filed.
        • Additional discussion centered on when the elections process would commence and/or whenever a violation could occur thus putting the election results in doubt.
      • Bill Harlan raised a concern of President Henry’s about phrasing.
        • The appropriate changes were made.
  • Proofread legislation.

LEGISLATION PASSED OUT OF COMMITTEE:
Motion was made and seconded to recommend Bill 09/10/31 favorably as amended. It was approved by a vote of 7-0-0.

  • There were no announcements.

GENERAL BUSINESS:

  • Chair Norris and Bill Harlan put together legislation including all of the remaining changes to the Statutes. The changes include:
    • A definition of campaign.
      • The definition would include an individual or individuals opposing a candidacy whether or not the individual is a candidate for any office.
      • As well as including a candidate or any matter voted on by the student body.
    • Renumbering.
    • The definition of campaign materials was moved to an earlier section of the legislation.
    • Removing the description of electoral race.
    • The definition of residence hall regions was moved into the definition section.
      • Jardine Apartments does not qualify as a residence hall. There were questions as to where to place it.
      • It was suggested terming it as any university property west of Denison Avenue, south of Kimball Avenue, east of College Avenue and north of Claflin Road.
      • Chair Norris provided a definition, which denotes the boundaries of Jardine are determined by Housing & Dining Services.
    • Wording within the election eligibility section.
    • Ensuring a primary election occurs regardless if two candidates declare or not.
    • Changing Student Identification Number to Wildcat Identification Number.
    • Ballots being distributed based on what a student’s primary college is.
    • A section on primary election certification.
      • Chair Norris suggested the commissioner could formulate a document.
      • The committee chose to word the provision to say the results would become official upon signature of the Elections Comissioner.
    • Appeals of contested elections will go to the Chancellor of the Student Tribunal.
    • Student Senate shall not amend unofficial elections results.
    • Adopted elections results may be annulled if validity is in question.
      • Senator Scott suggested not allowing annulment of an election.
      • Senator Muir suggested replacing Student Senate with Student Tribunal.
      • Bill Harlan agreed and suggested soliciting input from Attorney General Tank.
      • Senator Scott suggested an appeal could be made from a campaign to the Student Tribunal.
      • The committee agreed that the Elections Commissioner should follow the same rules in terms of contested elections.
      • The committee agreed the Student Tribunal should have the sole say in throwing out an election.
      • The committee agreed that any individual might contest an election to Student Tribunal.
      • Additionally, the notice of a contested election will be submitted to Student Tribunal no more than 48 hours after the unofficial elections results are released.
    • A section on signs was changed to read posters.
    • The section on mass distribution was broken down into subsections.
      • Removing the section on junk email.
    • The definition of harassment.
      • Basically stating that it would be continued solicitation beyond the initial verbal refusal.
    • The definition of banner.
    • Limits of personal contributions.
  • Proofread legislation.

LEGISLATION PASSED OUT OF COMMITTEE:

  • Motion was made and seconded for the Senate Operations Committee to author the Amendments to the Kansas State University Student Governing Association Statutes. It was approved by a vote of 6-0-0.

GENERAL BUSINESS:

  • President Henry presented a finalized version of his Advisory Board legislation, Bill 09/10/17. He requested a amendment be added changing a representative from the Multicultural Student Organization Office to a representative selected by the Multicultural Student Organization Leadership Council on line 78.
    • Senator Fangman moved that the amendment be made. The motion passed with a vote of 6-0-0.
  • President Henry presented a Commendation to Bethany Bohenblust upon her being selected to serve as a National FFA Officer.
  • President Henry presented a Resolution by the Governmental Relations Committee in support of handheld ban on texting and having it classified as a Secondary offence.
  • Proofread legislation.
  • Chair Norris opened discussion to changes of elections rules and regulations.
    • He presented the change regarding multiple complaints being filed for the same suspected violation. The complaints will be classified as one complaint with all complainants being combined as a complainant.
    • Senator Scott will speak with individuals at Jardine to define the boundaries of the complex.
    • Discussion opened on the issue of mass distribution.
      • Senator Fangman proposed defining mass distribution as anything excluding media advertisements.
      • Bill Harlan said there could be basic issues with the anything but this classification.
      • Bill Harlan proposed looking at the issues described in the paragraph separately.
        • He also noted the junk email policy is currently nonexistent.
      • Chair Norris solicited ideas on defining what a paid advertisement is.
        • He suggested using the wording of any media advertisement paid for by the campaign.
        • Bill Harlan suggested wording the provision to say that media advertisements purchased by a campaign should not be considered a violation. Additionally having another phrase, which requires identification in all advertisements promoting or opposing a candidate.
    • Discussion opened on contributions a candidate can make to their own campaign.
      • Chair Norris read the current regulations.
      • He noted confusion had resulted from Senators running in pairs and how to properly breakdown how to track expenditures.
        • The issue will be discussed further.
    • Bill Harlan noted past issues with certain sections.
    • Discussion ensued on the definition of academic buildings.
      • The committee believed the Rec should not be classified as an academic building.
      • Senator Scott expressed concerns about what vague wording could lead to.
      • Chair Norris proposed making all campus buildings off-limits except for the Union.
      • Senator Fangman said that specificity would be beneficial.
      • The committee decided to support making the Union the only campus building where postings be allowed.
    • Discussion shifted to the definitions of listservs.
      • Non-academic listservs are the ones allowable for messages to be dispersed over.
    • Senator Scott questioned if negative advertisements are allowable.
      • The advertisements are allowed.
      • Chair Norris noted that if a negative sign is hung and a complaint is violated, the burden is on the Elections Commissioner to possibly connect the person who hung the sign to the campaign in-question.
    • There were questions about when it would be permissible to wear campaign t-shirts and begin chalking.
      • Chair Norris will look into why those were not included.

LEGISLATION PASSED OUT OF COMMITTEE:

  • President Henry and Speaker Schultz presented a Resolution of Appointment concerning their appointments to the Student-Centered Tuition Enhancements Committee. The Committee reviewed the appointments and qualifications. Motion was made and seconded to recommend favorably the appointments of Garrett Boller, Jessie Dowell, Kate Wilmes, Naim Al-Amin, Megan Deforce, Matt James, Addison Kirkland, Molly McGuire, Kyle Reynolds and Lindsey Swoyer to the Student-Centered Tuition Enhancements Committee. Motion carried by a vote of 6-0-0.

GENERAL BUSINESS:

  • President Henry asked that the bill regarding the student body president’s advisory committee be held in committee.
    • It was moved and seconded that the bill be held in committee. The motion passed with a vote of 8-0-0.
  • Proofread legislation.
  • Speaker Schultz presented Bill 09/10/25 and discussed issues with Bill 09/10/09.
    • The current bill (09/10/25) repeals the previous bill (09/10/09) and makes the change from LSE Fee to a Rental Fee.
  • Speaker Schultz discussed the process regarding appointing an Elections Commissioner.
    • Speaker Schultz discussed how the position was advertised.
    • Four applicants applied.
    • Kathy Sexton proved to be the most qualified applicant.
  • Chair Norris opened the floor to questions regarding the Elections Commissioner position.
    • Chair Norris questioned Kathy’s commitments for the next semester.
      • She has 15 hours of classes strictly on Tuesdays and Thursdays.
      • Her Mondays, Wednesdays and Fridays are open and flexible.
      • She said she felt like she could fit the time commitments of the Elections Commissioner.
    • Chair Norris questioned how she would go about seeking out violations.
      • She said she believes she will come to an official conclusion based on the committee, Bill and Gayle’s perspective.
      • Her personal thoughts are to go into finding what questions she needs answered.
      • Also to ensure she would be in a position to see the violations.
      • She said she is willing to have more input from the committee as well as others who have ideas.
    • Chair Norris questioned whether Kathy knew of any parties running for office that might hamper her ability to be unbiased.
      • She has turned down an opportunity to serve on a campaign.
      • She says she has no plans to take part in any campaigns other than ensuring a fair process.
    • Chair Norris questioned whether she feels she’ll have a good working relationship with the OSAS personnel.
      • She said she knows they have a lot of knowledge and doesn’t anticipate problems.
    • Senator Fangman questioned whether she had ever been in a position where she has had to pass her own judgment on a situation and had to deal with the unpopularity of her decision.
      • She provided an example when she served as a State FFA Officer. In this position you have to be completely unbiased.
    • Senator Muir questioned if she had any conflicts of interest with the Student Tribunal or any of the appointing officers.
      • She answered that she had none that she was aware of.
    • Vice Chair Sharp questioned what her greatest weakness would be as Elections Commissioner and how she would resolve that.
      • She answered that she doesn’t like to be the bad guy all the time. She said knowing that everyone could not be made happy and that it’s part of life and something that must be accepted. She knows how important it is to not compromise and use your best judgment and not care if that hurts someone’s feelings.
    • Intern Reinert questioned if there had been a time where her integrity had been called into question and how she responded.
      • She said she had worked with a crop insurance business over the summer. When her boss was out of the state for a weekend, he entrusted her with making sure the business was ran well. A storm blew through and there was need for a claim to be filed. Licensed agents must enter policies, she chose not to and to find an alternate way of resolving it knowing it was more important to honor her personal integrity.
    • Senator Fangman questioned what the easiest part or most enjoyable part of being Elections Commissioner will be for her.
      • Kathy said it would be the communications aspect of it. She said believes making it known to the university community the positive nature of the changes the committee has made is part of it. Making sure communications are made to allow all candidates and campaigns are aware of what they need to do to ensure a fair elections process.
  • Chair Norris asked for a motion to favorably recommend the Resolution 09/10/48.
    • It was moved and seconded that the committee be added as authors. The motion passed with a vote of 8-0-0.
  • Chair Norris opened the floor to discussion of issues remaining in the Statutes such as contributions to campaigns, mass distribution and non-campus buildings as well as Jardine.
    • There was discussion over how Jardine should be classified.
    • Chair Norris read the definition of mass distribution.
      • Intern Fain questioned whether emailing five individuals at a time from a listserv.
        • It is allowable if it is on an individual basis.
      • Senator Scott said the issue of an individual sending an email without being prompted should be considered or defined.
        • Chair Norris said it has been hard to define that in the past.
      • Chair Norris read a section on distribution and how the ability to distribute could only be conducted by individuals to individuals.
        • Bill Harlan said it was to guard against mass distribution.
      • Chair Norris said he believed clarity was needed.
      • Senator Scott questioned the policy on ads in the Collegian.
      • Senator Muir questioned whether media advertisements should be allowed.
        • Several committee members agreed that is should be allowed.
      • Questions were raised about requiring stamps with who sponsored each piece of campaign material.
      • Chair Norris encouraged the committee to think of ways to make it a better process.
    • Chair Norris opened discussion to that of amounts donated to campaigns.
      • $20 could be donated to presidential campaigns.
      • $5 to other elections.
      • There was discussion about personal contribution amounts.
      • Chair Norris brought up the topic of multiple candidates running together.
        • There had been some confusion in the past in terms of filling out expense reports.
        • Clarification was provided in terms of accounting for campaign materials that are shared by multiple candidates.
        • Chair Norris said he would review it to try and provide additional clarity.
    • The committee discussed the lack of clarity that existed when multiple signs are hung in an improper location.
      • Essentially it has been an interpretation issue.
    • The committee decided multiple complaints filed for the same violation would be consolidated into a single complaint.
    • The committee decided to define Jardine and include provisions about following handbook policies.
  • Chair Norris encouraged the committee to review the rules and regulations and to discuss issues with fellow senators.

LEGISLATION PASSED OUT OF COMMITTEE:

  • Vice President Stoskopf presented Bill 09/10/21 and discussed the structure changes. After having discussions with Gayle and Speaker Schultz, they decided it was best to keep the structure as it was.
    • It was moved and seconded for the committee to co-author Bill 09/10/21. It was approved by unanimous consent.
    • It was moved and seconded that Bill 09/10/21 be passed out of committee favorably. The motion passed with a vote of 8-0-0.
  • Speaker Schultz presented Bill 09/10/22 and explained an issue with the appointment process.
    • It was moved and seconded that the power to make appointments be given to the Speaker of the Student Senate rather than the Speaker Pro Tempore. The motion passed with a vote of 8-0-0.
    • It was moved and seconded that the committee be added as authors. The motion passed with a vote of 8-0-0.
    • It was moved and seconded that the bill be passed out of committee favorably. The motion passed with a vote of 8-0-0.
  • Chair Norris presented Bill 09/10/20.
    • It was moved and seconded that the bill be passed out of committee favorably. The motion passed with a vote of 8-0-0.

GENERAL BUSINESS:

  • Chair Norris noted that Bill 09/10/17 was re-referred back to the committee.
    • The cabinet wanted input on who would be on the advisory committee.
    • Senator Muir motioned to hold Bill 09/10/17 in committee and to author the legislation. The motion passed 5-0-0.
  • Chair Norris brought up Bill 09/10/16 which deals with the new minimum wage and the Educational Opportunity Fund.
    • Senator Abbott motioned to send Bill 09/10/16 back to Senate favorably. The motion passed 6-0-0.
    • Senator Scott motioned for the committee to author Bill 09/10/16. The motion passed 5-0-0.
  • Speaker Pro Tempore Oliver introduced legislation regarding amendments to the By-Laws relative to the Campus Activities Board.
    • The amendments will remove the Fine Arts Council from the By-Laws as it no longer exists and replacing it with a representative of a student organization selected by the Office of Student Activities and Services.
    • Senator Muir expressed concerns with appointments coming from OSAS. He said the appointments usually come from Senate.
  • Vice President Stoskopf introduced amendments to the Statutes regarding the Student-Centered Tuition Committee.
    • The amendment removes the University Relations Committee chair as a voting member and altered some other wording.
    • Senator Muir questioned whether it would be necessary to add the chairs of the Public Relations Committee and Campus Outreach Committee.
    • Speaker Schultz said she did not believe that was necessary.
  • Speaker Schultz provided allocations legislation regarding the Educational Opportunity Fund and an allocation to the Asian-American Student Union and S.H.A.P.E.
  • Chair Norris opened discussion to how the Elections Review Commissioner could be removed from office.
    • He read the amendment that Senator Muir proposed on Thursday.
  • Senator Champlin introduced an amendment to the Constitution regarding impeachment proceedings against any member is appointed by Student Governing Association.
    • Senator Muir noted there might be logistical issues behind an impeachment proceeding.
    • He said if the Student Senate accepted the amendment it would be okay but it would be setting a precedent.
    • Senator Savoy questioned noting the branches of government and including the Elections Review Commissioner.
    • Chair Norris noted he had a similar idea upon reading the legislation.
    • Senator Savoy questioned if there would be frequent impeachments if this passed.
    • Chair Schultz questioned whether just cause would have to be provided.
    • Chair Norris said providing just cause was noted.
  • Senator Weston presented ideas regarding removal and other issues of the Elections Review Commissioner.
    • Have the Elections Review Committee consist of five members of any judicial branch except the Student Tribunal, Assistant Attorney General or Attorney General.
    • Elections Review Committee meetings will have a set time.
    • Major violations cases are not to be made public until after a ruling has been rendered.
    • The Student Body President, Attorney General or Speaker of the Student Senate or 10 Student Senators can call a Special Senate meeting. If the Elections Review Commissioner were to be removed, the assistant attorney general would be named Elections Commissioner while a replacement is sought.
  • Chair Schultz questioned who could call a special meeting.
    • Speaker Schultz noted that the Speaker could with little notice. The Student Body President can with 24 hours notice and with the agreement of at least 10 Student Senators.
  • Speaker Schultz said the process could become too drawn out over time.
  • Chair Schultz questioned whether the Senate could override a provision regarding calling a special meeting.
  • Bill Harlan proposed that the Senate Operations Committee examine how the Elections Review Commissioner fits into the process before reaching a conclusion.
  • Senator Champlin questioned whether another system existed to remove the Elections Review Commissioner from officer.
  • Senator Muir suggested utilizing the By-Laws bill for removing the Elections Review Commissioner from office.
  • Bill Harlan said the committee should provide for the removal.
  • Senator Muir said the two choices could be: a 2/3 vote of Student Senate or by the three appointing officers.
  • Speaker Schulz questioned whether wording could be placed in the legislation to require the Student Senate to approve an appointment within a 48-hour period following removal.
  • Chair Norris took a straw poll regarding the committee’s views on the issue.
    • The committee supported an either/or option for a 2/3 vote of the Student Senate or by the three appointing officers.
  • The committee discussed options regarding calling a special meeting.
  • Chair Norris read the amendment.
    • The amendment includes a provision for a 2/3 vote of those selected and qualified in Student Senate.
  • Senator Muir presented a conceptual idea regarding the power of the Elections Review Commissioner.
    • He suggested that a single person would serve as an in-between person between the commissioner and tribunal.
    • He suggested that the Attorney General would serve as the in-between person.
  • Bill Harlan expressed concerns that the Student Tribunal would essentially not function in the appeal process.
  • Chair Norris presented an idea that was given to him by Senator John Richards about the Elections Review Commissioner not being allowed to police major violations but being allowed to do so for minor violations.
    • The committee was not supportive of the idea.
  • Senator Scott moved that Bill 09/10/05 and Bill 09/10/13 be recommended favorably. The motion passed with a vote of 5-0-1.

 LEGISLATION PASSED OUT OF COMMITTEE:

  • The committee reviewed Bill 09/10/17. Senator Muir motioned to hold the bill in committee and to author the bill. Motion passed with a vote of 5-0-0.
  • The committee reviewed Bill 09/10/16. Senator Abbott motioned to recommend favorably the bill to Senate. Motion passed with a vote of 5-0-0.
  • Bill 09/10/05 and Bill 09/10/13 were recommended favorably by a vote of 5-0-1.

  • The application went live on Web site today for the Elections Review Commissioner. Applications are due next week. Interviews will follow the week after. The commissioner should be in place by the end of the month.

GENERAL BUSINESS:

  • Proofread legislation.
  • President Henry presented an amendment to the By-Laws regarding the Student Body President’s Cabinet. The amendment related to the Creation of Student Body President’s Advisory Board. Members of the advisory board would include: the President of Graduate Student Council or designee, President of Inter-Fraternity Council or designee, President of the International Student Coordinating Council or designee, A representative of the Multi-Cultural Student Organizations selected by the Multi-Cultural Student Organization office, A representative of Non-Traditional students selected by the Non-Traditional Student Office, President of the Pan-Hellenic Council or designee, President of the Association of Residence Halls or designee, The College of Technology and Aviation Student Body President or designee, A representative of student athletes selected by the Department of Athletics, A representative of the Campus Sustainability Office recommended by the Director of Sustainability, and such other officers appointed by the Student Body President.
  • Chair Norris opened discussion to the By-Laws amendments and Statutes. .
    • He reviewed the By-Laws revisions.
      • Speaker Schultz questioned whether there was a way if the By-Laws and Statues passed to allow for additional time in appointing the Elections Review Committee this year.
      • Senator Muir proposed adding November 1 as the date each goes into effect.
    • Chair Norris reviewed the grammatical changes to the Statutes.
    • General discussion commenced on the content of the Statues.
      • Senator Champlin brought up the Appeals of Violations section.
        • He believes it doesn’t spell out who can file a violation.
      • Senator Champlin brought up adding a section of appeal for a penalty being too soft.
        • Chair Norris said this concern had been raised to him.
        • Senator Savoy provided an example.
        • Chair Norris said the idea stemmed from potential favoritism of one campaign.
        • The committee agreed it should be included.
        • Senator Muir proposed including wording about too much leniency.
        • Senator Savoy said he believed everything should be enumerated so newcomers to Senate could know all of the specifics.
        • Chair Norris added to line 284 a specification about a penalty being too lenient.

          • Senator Huschka said he had spoken with a lawyer and found the current system to be “ludicrous.”

          • Senator Muir said in the past the Elections Review Commissioner had functioned as an educator and enforcer.
        • Senator Savoy said he admired Senator Huschka’s intention of being unbiased but said he believes bias will exist regardless.
          • The ability to appeal to the Student Tribunal makes this a good process.
        • Senator Scott said she believes there is something staunchly wrong with a person being able to judge and file complaints.
          • You cannot compare it to the United States.
          • There are a lot of checks on the Elections Review Commissioner and the person can be removed easier.
          • She said the way it is set now is the best possible way.
        • Senator Huschka raised a question of timeliness.
          • Chair Norris said there is 48 hours for the Elections Review Commissioner to investigate and the review has to be made during this time.
          • After the review, the Elections Review Commissioner has three hours to rule.
          • An appeal must be filed within 15 hours after the completion of the hearing.
        • Senator Huschka questioned whether including the same timeline but having a judge.
        • Senator Huschka said giving that much power to one individual is unreal.
          • Chair Norris said he believed it would be productive because of the training that the Elections Review Commissioner must undergo.
          • Senator Scott said there would be a more intense vetting process to help eliminate bias.
          • Chair Norris said the appointee will come to the Senate Operations Committee and answer questions.
          • Senator Huschka expressed worries about elections in the future and the potential for Senate to not be monitoring the process as closely.
          • Bill Harlan said the regulations would not look like this in five years so the focus should be on what could currently be improved upon.
            • Bias has not been an issue with the exception of the past year.
            • He said he doesn’t want people to get caught up with what happened in years past.
            • He said the system is good enough and what it needs to be.

            • Chair Norris said it also stemmed from an inability to have qualified members serving on the committee.
            • Senator Huschka said he didn’t believe it would be duplicating a person because the person would be separate and not have prior knowledge of the complaint.
            • Senator Huschka said it makes him feel better with someone judging and someone filing a complaint.
              • Senator Scott said it would be a good idea in a perfectly Utopian system.
            • Bill Harlan said having the attorney general or another individual adjudicate a complaint takes the process out of legislative hands.
              • He said the Elections Review Committee ruling incorrectly was a motivation for having the system set up as it is.
            • Bill Harlan said he understands the concerns but feels it’s a good system and having another person outweighs the issues with bias.
            • Senator Huschka questioned having the Collegian print information regarding complaints.

            • Senator Savoy said the issue of filing complaints should be addressed and the Collegian should not be excluded from the process.

  • Proofread legislation.
  • Discussion of Statutes changes.
    • Chair Norris presented the definitions section.
      • Major and minor violations are being placed in Section 110. The change is being made to bring a more natural flow.
    • The committee reviewed the section on Reviews of Suspected Violations.
      • The same process reviewed earlier is entailed within.
      • Chair Norris questioned whether wording noting the Coordinator of Student Activities, as council to the Elections Commissioner was appropriate and understandable.
        • The change was made to note the Coordinator would function as a counselor.
      • After completion of the hearing, the Elections Commissioner may no longer investigate a suspected violation.
      • Chair White questioned the point of a hearing after the commissioner decides to move forward with a case.
        • Bill Harlan said it was a technicality that notes a hearing took place.
      • Chair Norris questioned whether a section should be included about allowing the party filing the complaint to withdraw a complaint.
        • Senator Fangman said he believed a section should be added.
        • Bill Harlan added the section as Chapter 50 Section 148B.
      • Bill Harlan added a section noting that if the respondent chooses to admit the violation, it will be considered at the time of the hearing.
    • The committee reviewed the Determination of Violation section (50-0150).
      • Bill Harlan questioned condensing the section noting that the determination of violations shall be done by the Elections Review Commissioner in counsel with the Coordinator of Student Activities or designee to the basic definition of determining the violation.
      • The section on penalties was changed into include wording about the past number of violations being eligible to be considered in determining penalties.
      • The committee examined questions surrounding the section on disqualifications and primary elections candidates who fail to remove their campaign materials.
      • The committee removed a reference to the Elections Review Committee from 50-0150-6.
    • The committee reviewed the Appeals of Violations section (50-0154).
      • The subsection referring to notification of an appeal was changed from notification by the Elections Review Commissioner to the Chancellor of the Student Tribunal. The Elections Review Commissioner will also be notified when an appeal is made.
      • The committee examined the question of what records used in the appeal would qualify as.
        • Chair White raised questions whether interpretation could be considered.
        • Speaker Schultz said the Student Tribunal could deliver a different sanction.
      • The subsection on appeals to the Student Tribunal following the SGA By-Laws was changed to include an exception for specific exceptions provided for in the Elections Regulations Code.
      • A subsection was added to the Appeals of Violations section regarding notification.
        • At the completion of the hearing Student Tribunal shall notify the original complainant and respondent, the Elections Commissioner and make public the decision of the appeal.
    • The committee reviewed the remaining sections.
      • The Elections Commissioner shall submit to the Senate Operations Standing Committee a complete analysis on the election held and recommendations made to improve future elections was set as 50-0159.
      • The section on records was set to note that documentation and recordings of the suspected violations, notifications and reviews, determinations of violations and appeals for a period of five years.
      • As well as the Elections Commissioner’s analysis of the elections.
      • The expense reports will be kept for a period of one year.
    • The section on major offenses was changed to note that failing to comply with rulings would result in paying restitution rather than a fine.
    • A section on making public was clarified.
    • Chair White raised concerns about the initial hearing process and the fact that the Elections Review Commissioner would be playing multiple roles.
      • Chair Norris noted that is why the Elections Review Commissioner would be appointed at an earlier date to avoid them having a bias.
      • Speaker Schultz said the transparency in the process has assuaged fears of bias and the one-sided filing of complaints.
      • Bill Harlan said he believed the person should be trusted to their job or not trusted. Removing the commissioner from the rules might be the only solution.
      • Parliamentarian Spriggs said he believed there might need to be someone who reports to the commissioner.
      • Bill Harlan questioned why Chair White would trust the deputy commissioner to be in place of the elections commissioner.
      • Chair White explained that the deputy commissioner would file complaints and the elections commissioner would judge.
      • Speaker Schultz questioned whether that would essentially be a duplication of the same role.
      • Intern Fain said that’s why the appeal exists.
      • Bill Harlan compared the process to a judge finding a person in the court in contempt.
      • Bill Harlan suggested including a section about documentation stretching beyond what the elections commissioner would see. Stretching to pictures or similar forms of evidence.
      • A section was added to note that undocumented personal observations by the elections commissioner are not sufficient grounds to file a complaint.
      • Bill Harlan said a photo or similar form of evidence is ground enough to proceed with a complaint.
    • Chair White said she believed it would be appropriate to have the elections commissioner function as a judge and the deputy elections commissioner function as a police.
      • She said she believed it was a lot of power for one person.
      • Bill Harlan said he believed the role of the elections commissioner was possibly being overstated.
      • Bill Harlan said the new definitions for the roles would help bring clarity to the situation.
      • Issues of too much discretion were there.
      • Chair White and Chair Schultz raised concerns about the role of the election commissioner.
      • Intern Fain questioned some of the issues that occurred last year.
        • Senator Fangman noted the long appointment/training process would help prevent previous issues.
      • Chair Schultz expressed that she still didn’t feel the system was right.
        • She said she felt it was an improvement in defining the process.
        • But that there wasn’t anything requiring him/her to file complaints. It would be at the discretion of the commissioner.
      • Bill Harlan expressed that there should faith placed in the appointments.
        • Otherwise, do not appoint them or remove them from the process.
      • Bill Harlan and Gayle Spencer do not advise the commissioner to file complaints.
      • Senator Fangman moved to table discussion until Thursday.
    • The committee added a section to 50-0148.
      • A new subsection B was created to read The Elections Commissioner shall make a reasonable effort to seek out all suspected violations and file complaints.
    • Intern Fain motioned and it was seconded to author and recommend favorably the Statutes amendments. It was approved by a vote of 6-0-0.

The committee reviewed the legislation and appointment process. Motion was made and seconded to recommend favorably the appointment of Vincent Adams, Taylor Concannon, Debbie Dolechek, Morgan Gauby, Brian Koester, Jessica Schultz and Casey Walker to the Long-Term Tuition Strategies Committee. It was approved by a vote of 6-0-0.
  • President Henry presented a Resolution of Approval of Recommendations for President’s Advisory Committee on Intercollegiate Athletics. The committee reviewed the legislation and application process. Motion was made and seconded to recommend favorably Annie Bachman, Jamie Ball, Peter Boos, Cole Galyon, Erin Gettler, Andrew Huschka as potential members of the President’s Advisory Committee on Intercollegiate Athletics. It was approved by a vote of 6-0-0.
  • President Henry presented a Resolution of Appointment concerning a new Student Affairs director. The committee reviewed the legislation and application process.       • The committee agreed a more formalized script should be established for the hearing process.

GENERAL BUSINESS:

  • Proofread legislation.
  • Chair Norris met with Speaker Schultz and Attorney General Tank regarding ways of getting around the Elections Review Commissioner’s functioning as a judicial board not being a Constitutional issue.
    • They proposed a fix in the form of filling the role of the Elections Review Committee with the Student Review Board.
    • The timeline was examined and it appeared to be as drawn out as it is now.
    • The proposed fix would be to move the primary elections back one week.
      • All other deadlines would be adjusted accordingly.
      • Bill Harlan expressed that he and Gayle Spencer didn’t think it would be a good idea. Three weeks is a long time to campaign and cost becomes a more predominate issue.
        • Timing concerns will still exist. It will merely be an additional week to file a complaint.
        • Bill Harlan said he worries that it’s not addressing the issues.
        • Senator Weston said one problem with the appointment process was that he was asked to serve during the week of appointments.
        • He said he believes there should be set times for potential complaints rather than trying to coordinate multiple schedules.
    • Chair Norris questioned whether a student’s right to an appeal would be violated.
      • Attorney General Tank said it would not technically fulfill the definition.
    • Chair Norris said he keeps returning to the idea of the Elections Review Commissioner rendering an initial ruling then allowing appeals to be made to the Student Tribunal.
    • Bill Harlan read from the By-Laws regarding what an appellant is.
      • There is no explicit definition of a ruling stemming from a board initially.
      • He said he believes all systems that have been presented fulfill the role of allowing a proper appeal process.
    • He encouraged the Committee to think about how they want the Election to be run. A new framework may be established to make the elections work right.
    • Chair Norris questioned what the Committee’s views on the originally proposed process.
    • Senator Weston questioned Chair Norris’ views on how the Elections Review Commissioner is selected.
      • Chair Norris noted the joint appointment would still be made. The appointment would be asked to attend a meeting of the Senate Operations Committee to answer questions of their qualifications for the position.
      • The appointment would be made by the third Thursday of October.
    • Senator Weston asked what happened if the Senate did not approve of the appointment.
      • The process would be repeated if the Senate did not approve.
    • Bill Harlan presented grounds for review of a violation essentially stating that an Elections Commissioner did not have appropriate evidence.
      • Chair Norris noted that the provision had already been included.
    • Senator Weston questioned the issues of power given to the Elections Commissioner.
      • Chair Norris noted that more time was being allowed for the Commissioner to become privy to the rules and regulations.
      • Senator Weston questioned if an election of an Elections Commissioner within the Senate body would be feasible.
        • Speaker Schultz stated that the position is not a highly sought after position.
        • Senator Scott said there had been discussions about a potential appointment hearing within the Student Senate body.
        • Speaker Schultz said she believed that may tie the Elections Commissioner to one branch rather than the shared responsibilities the position currently has.
      • Bill Harlan said the result last year was an abnormal one from a system that usually works.
      • Senator Scott noted that a special session of Student Senate can be called for removal of an Elections Commissioner.
    • Chair Norris took a straw poll vote regarding moving forward with the initial outline.
      • The Elections Review Commissioner would hold an initial review. Followed up with a review to the Student Tribunal.
      • Senator Muir expressed his belief that the Elections Review Commissioner should be classified as a judicial board to avoid judicial interpretation issues at a later date.
    • Bill Harlan read from Article VI Section 1 of the SGA Constitution about the definitions of judicial boards.
    • Senator Scott questioned what negatives would result from the Elections Review Commissioner be qualified as a board.
      • Bill Harlan provided those.
    • Bill Harlan said he would not be opposed to defining the Elections Review Commissioner as a judicial board, if there was a reason. He said he could not think of a compelling reason though.
    • Speaker Schultz questioned whether the Elections Review Commissioner should be allowed to file complaints.
      • She expressed concerns of bias resulting from the roles of the position.
      • Bill Harlan expressed that if you don’t allow the Elections Review Commissioner to do so, would just have the commissioner to find a colleague to file a complaint.
      • Bill Harlan said this might result from a lack of concrete discussion with the Elections Commissioner regarding the complaint process.
      • Speaker Schultz questioned whether there would actually time be saved.
      • Chair Norris noted that the Student Tribunal could choose the cases, which they want to hear.
        • Attorney General Tank said cases can be thrown out but all must be heard.
      • Senator Scott expressed concerns that the process was not fair, allowing the Elections Commissioner to investigate and rule on a complaint they made.
      • Chair Norris questioned the use of a Deputy Commissioner.
      • Speaker Schultz noted that that is how the idea of utilizing the Student Review Board was ultimately arrived at.
      • Senator Scott said she believes a good ultimate solution would not be allowing the Elections Commissioner to make complaints.
      • Bill Harlan said making complaints a part of the “political game.”
      • Speaker Schultz questioned whether the issue of utilizing the Student Review Board as the initial judicial body was one of time.
        • Chair Norris said it would create a longer process.
      • Senator Scott raised concerns about bias.
      • Attorney General Tank noted questions of a “fair” hearing.
      • Chair Norris noted the proposed process mirrors the current process for minor violations
      • Bill Harlan noted that the Elections Review Commissioner meets with Gayle with their complaints.
    • Bill Harlan proposed a system where the Elections Review Commissioner would handle everything themselves.
    • Attorney General Tank proposed a system where the Elections Review Commissioner serves as a complainant and the candidates as the respondent. The Attorney General or another judicial branch member would serve as a chair.
      • Bill Harlan expressed concerns that it would remove more control from the legislative branch.
      • Senator Scott proposed allowing the attorney general to file complaints.
    • Chair Norris proposed having a deputy commissioner to file complaints.
    • The idea of a Senate Operations Committee member filing complaints was proposed.
    • Bill Harlan agreed that a ruling be issued by the same individual who filed a complaint could be problematic.
    • There was general discussion that there is a lack of information about people filing complaints.
    • Chair Norris expressed interest in using violations rather than complaints.
      • He also noted though that that might hamper the appeal process.
      • Senator Scott said there are some legitimate complaints.
    • Senator Scott proposed coming to a conclusion about the issue of the Elections Review Commissioner filing a complaint.
    • Bill Harlan noted that time still remains for changes to the Statutes.
      • He recognized that there are still concerns about the Elections Review Commissioner acting as a czar.
    • Bill Harlan said he believed he’d be shocked if the Committee was stranded without a solution.
  • The committee next reviewed the financial contributions section.
    • Chair Norris said he believes the Student Senate personal contribution is sufficient.
    • Senator Muir said the numbers are arbitrary.
    • Numbers have not adjusted with inflation.
    • Any donations not from students are taken out of personal contributions; Chair Norris noted this might be an issue.
    • Bill Harlan noted that there was a lack of clarity regarding non-student donations.
    • Senator Muir noted that the cost of living has risen 20% over the last five years.
    • Senator Muir said he believed the numbers were artificially low.
    • Bill Harlan said the committee should consider what they want to see in elections when considering the figures.
    • The committee’s consensus was keeping the numbers at their current levels.
  • The committee reviewed the shared contributions section.
    • Bill Harlan clarified that the intention was costs being one in terms of promoting or opposing a campaign.
  • Chair Norris said the committee should clarify violations.
  • Bill Harlan noted an area for potential change. Article IV Section 4C1 of the By-Laws calls for the Speaker to fill in as interim Student Body President if both Student Body President and Vice President leave.
    • If the Speaker is unable to fill that vacancy, the section calls for an Emergency Elections Committee to be established to fill the vacancy.
  • Bill Harlan also presented Article VI Section 5C3 of the By-Laws and how it references the Elections Review Committee.
  • Senator Muir questioned including the Statutes changes with the By-Laws changes.
  • Chair Norris expressed his belief that the committee should add itself as an author of the legislation.

LEGISLATION PASSED OUT OF COMMITTEE:

  • Speaker Schultz presented a Resolution of Appointment concerning one Student Senator being appointed to the Diversity Programming Committee. The Committee reviewed the appointment and qualifications. Motion was made and seconded to recommend favorably the appointment of Samuel Brinton to the Diversity Programming Committee and to co-author Resolution 09/10/35. Motion carried by a vote of 5-0-0.
  • Speaker Schultz presented a Resolution of Appointment concerning two Student Senators being appointed to the Educational Opportunity Fund Committee. The Committee reviewed the appointments and qualifications. Motion was made and seconded to recommend favorably the appointment of Jessica Schultz and Molly McGuire to the Educational Opportunity Fund Committee and to co-author Resolution 09/10/36. Motion carried by a vote of 5-0-0.
  • It was moved and seconded that the Senate Operations Committee be added as an author to Bill 09/10/05 and to recommend favorably for passage as well as to be reprinted with amendments. Motion carried by a vote of 5-0-0.

GENERAL BUSINESS:

  • Chair Norris presented the proposed By-Laws amendments
  • He opened the floor to questions.
    • Senator Muir asked if there had been suggested additions.
    • Speaker Schultz said the primary concern was whether the appeals process violated the Constitution. She said it was determined that the proposed appeals process would not violate the Constitution.
    • Senator Muir said there is a section in the By-Laws regarding what an appellant is.
      • Article VI potentially poses an interpretative problem with previous judicial problems.
      • It can be improved upon by defining the Elections Commissioner as a review board.
      • Attorney General Tank said it does not violate the By-Laws because of the ability to appeal to a higher judicial authority in this case, the president of the university.
      • He also said it could be argued that the initial appeal in that the Elections Commissioner does not function as a judicial board.
      • Chair Norris said it makes sense to adding a section to the By-Laws noting the Elections Commissioner would be considered a review board.
      • Senator Muir said for purposes of following Article VI that Chair Norris should do that.
      • Speaker Schultz asked if it could be included in the second subsection of Article I, Section 1.
      • President Henry said he feels the direction the committee is going to make the Elections Commissioner function, as an appeals board is the right one.
        • He said he thinks some changes are reactive to the past year’s election.
        • But he feels this change is proactive.
        • He said he would like to leave it in the confines of student government.
      • Senator Shane asked how the system works now.
        • Chair Norris explained the process noting that if there’s a violation, the Elections Commissioner will determine if is a major or minor violation and determines consequences. A major violation will go to the Elections Review Committee. If that decision is appealed it will go to the Student Tribunal.
        • Senator Shane also asked about the Deputy Elections Commissioner.
        • CCAC Chair White asked about the determination of the violations.
          • Chair Norris noted that it would stay in the statues as major or minor violations but the Elections Commissioner would make the initial determination.
        • Senator Muir noted that the Attorney General mainly runs the judicial branch, not as an adjudicator.
        • Senator Shane asked about the Elections Commissioner replacing the committee.
          • The committee noted this was the considered change.
      • Chair Norris noted the committee is also trying to streamline the review process and future determinations will be made beyond the 3 ½ days set aside for a review process.
      • Senator Muir noted he did research and looked at the 2002 elections, which were also contentious.
        • Because of abstentions nobody actually won the election with a majority.
        • The judicial branch had to order the elections not to occur and then to subsequently write a letter as to what will be counted.
        • He made the letters available to all individuals at the meeting.
      • There was discussion about formally making the Elections Commissioner a judicial board under Article VI Section 1 of the K-State SGA By-Laws. This addition would be made at the end of Section 1 A-2 of the K-State SGA By-Laws.
        • Senator Fangman motioned to pass the By-Laws as amended. It passed 6-0-0.
        • Senator Muir moved that the Senator Operations Committee be added as authors. The motion passed 6-0-0.
        • Senator Muir moved the bill be reprinted for the next agenda and including it in the agenda for the next week.
      • Speaker Schultz said she didn’t believe the By-Laws would be passed if the Statues could not also be viewed at the same time. She suggested re-introducing with the changes.
          • Senator Muir noted that could only be done under suspension of the rules.
          • President Henry recommended that the Senate Operations Committee provide a document to be dispersed at Thursday’s meeting so the Student Senate could review them.
  • Senator Muir moved the bill be held in committee as amended. The motion passed by a vote of 6-0-0.
  • The committee then reviewed the Statues.
    • Chair Norris and Speaker Schultz had earlier reviewed them and made changes.
  • Speaker Schultz presented a definition of campaign to be added as Section 106 of Chapter 50.
    • It would involve persons actively promoting for a candidate as part of a campaign or cause.
    • Bill Harlan, Chair White and Senator Shane expressed reservations about the definition.
      • She provided an example of the Collegian indirectly benefiting a campaign with something they write.
    • Bill Harlan said the definition should be more general.
    • Senator Shane said there should be trust in the campaigns and to try not to hold each member of a candidacy responsible.
    • Bill Harlan said the loose affiliation has been used to someone’s advantage in the past.
      • He said there should be some framework provided for the judicial body.
    • Chair Norris explained that this was an attempt at holding members of campaigns accountable.
    • Senator Shane asked about documenting individuals involved within a campaign.
      • Bill Harlan said that still presents a lack of accountability for certain campaigns.
  • She presented changes to the sections regarding primary and general elections.
    • She said the changes were made for consistency purposes.
    • Bill Harlan noted that a primary election must occur regardless of two pairings entering. That change was removed.
    • In the general election section, she added a purpose.
  • Speaker Schultz questioned whether including the number of student senators should be included in the Statutes.
  • Speaker Schultz presented Section 117 about removing the Deputy Commissioner and Elections Review Committee from the list of entities that could not be candidates for elections.
  • Speaker Schultz presented Section 130 about Primary Election Procedures.
    • The Elections Commissioner releases the unofficial totals after the completion of tabulation of the votes. Additionally it notes that the results will be made official upon certification by the Elections Commissioner.
    • The Section notes that there is a 48-hour period to contest unofficial results have been issued. The Elections Commissioner has 72 hours to determine the nature of the contest of the Primary Election.
    • The committee agreed the sections should be reviewed more thoroughly and changed.
    • Bill Harlan said the reason for announcing unofficial results is to ensure accurate totals.
  • Speaker Schultz presented Section 133 and the addition of Jardine Apartments as a region similar to the existing Residence Hall region.
    • The committee tried to refine the definition of Jardine’s boundaries.
    • An addition will be made regarding following the rules of Jardine’s judicial board.
  • Speaker Schultz presented changes to the Section about mass distribution.
    • The change included noting a campaign cannot mass distribute campaign materials.
    • Chair White proposed including Collegian advertisements in the mass distribution section.
    • Bill Harlan said the only argument that can be made about mass distribution is that it could be connected to leaving a lot of leaf lets in one location.
    • The advertisement issue will be discussed further.
  • Speaker Schultz presented Section 137 regarding the rotation of candidate’s tables.
    • The committee and Bill Harlan worked with Speaker Schultz about refining the wording of the section.
  • Speaker Schultz presented Section 138 about posters being tacked to bulletin boards in non-academic campus buildings.
    • The committee added a section about permitting posters or campaign materials to be tacked on outside bulletin boards such as the ones adjacent to King Hall or Waters Hall.
  • Speaker Schultz presented Section 140 regarding authority to remove.
    • The proposed section was changed.
    • Senator Muir proposed allowing the section to note a person designated by the Elections Commissioner.
  • The committee decided to review dollar amounts spent on campaigns at a later meeting.
    • Speaker Schultz encouraged reviewing the rules of other Big 12 schools regarding spending.
    • Bill Harlan questioned whether separating the expenses of t-shirts should be separated from general expenses.
    • Speaker Schultz noted that students are not allowed to contribute money to themselves if they are a candidate in addition to a personal donation.
  • Speaker Schultz presented Section 147 eliminating the Elections Review Committee.
    • Under the section regarding major offenses, the section is changed to read the Elections Commissioner shall conduct a review concerning all major violations defined by the Elections Regulations Code.
    • Bill Harlan proposed changing wording to note the Elections Commissioner shall conduct an investigation and review of a suspected violation in an earlier subsection of the same Section. As well as determine whether it is a major and minor violation.
    • Attorney General Tank expressed reservations about including investigation because the review should not include any investigations.
    • Chair White argued that leeway should be allowed for the Elections Commissioner to investigate.
    • Attorney General Tank said ownership should fall on the person presenting a complaint.
    • Bill Harlan said a lack of information might hinder the process.
    • Chair White argued that there should be room to allow for a non-biased investigation.
    • Attorney General Tank noted judicial boards are not typically allowed to investigate.
    • Senator Muir proposed adding a sentence to subsection B allowing the Elections Commissioner may conduct an investigation or call additional witnesses if there is not sufficient evidence presented.
    • Senator Scott expressed reservations about having a “judge” conducting an investigation.
    • Parliamentarian Sexton proposed having a Deputy Commissioner to file complaints.
    • Bill Harlan expressed support for allowing the Elections Commissioner to make complaints because of lack of information for the student body at-large regarding what violations are.
    • Chair White also expressed support for the idea of a Deputy Commissioner.
    • Speaker Schultz and Chair Norris noted that support seemed to be making a Deputy Commissioner function as the Elections Commissioner.
    • Senator Muir articulated that support was behind an enforcement agent and a complaint agent.
    • Chair White noted that it might be a better accountability measure for smaller campaigns as well that bigger campaigns may not monitor.
    • Bill Harlan proposed a system where if you went over your expense amounts it would be an automatic violation. Thus eliminating the gray area.
    • Bill Harlan expressed support for getting rid of trivial rules to reduce the amount of trivial complaints.
    • Senator Muir said a broader, more transparent process would help get rid of triviality.
    • The committee discussed nuances of the appeal process and inclusion of different candidates who have appealed.
    • Senator Muir said if the committee wants to have both sets of candidates included in a review/appeal, it could be done.
    • Chair White expressed hope that it would alleviate previous problems with differing interpretations.
    • Bill Harlan noted that differing interpretations are not reviewable.
  • Speaker Schultz presented Section 151 Subsection A-1 and noted that the change would allow disqualification by a major violation by members of a campaign.
    • In addition, the subsection regarding Elections Review Committee has been changed to Student Tribunal.
    • The section was changed to emphasize the Elections Commissioner being able to consider the severity of violations and possible mitigating factors.
  • Speaker Schultz presented Section 152 regarding disqualifications.
    • The sections would be changed from Elections Review Committee to Elections Commissioner.
  • Speaker Schultz presented Section 154.
    • The Grounds for Appeal section was changed to update from Elections Review Committee to Student Tribunal and Elections Commissioner on an individual basis.
    • The Grounds for Appeal section was branched off the judicial branch’s Grounds for Appeal to including failure to provide a fundamentally fair process, failure to follow written procedures and rules, lacking substantial evidence to support finding a violation.
    • Additionally if the Elections Commissioner reached a decision in an unjust manner with existing biases.
    • Also the sanction is too harsh and The Elections Commissioner denied a candidate his/her constitutional rights, as identified in the SGA Constitution.
    • Chair White questioned the possibility of accounting for an incorrect interpretation by the Elections Commissioner and whether that would be accounted for under the Elections Commissioner failing to follow written rules and procedures.
    • Speaker Schultz said it would be based on Tribunal’s decision on whether or not to hear the case.
  • Speaker Schultz presented the removal of the final two sections regarding the appointment time because it will be included in the By-Laws.
  • Chair White expressed that it would be appropriate to include past presidential candidates in the reforming process.
  • Chair Norris reiterated the importance of the time frame and the committee reviewed the time frame of the appeal process.
  • There was a motion made to hold Resolution 09/10/26 in committee. The motion passed 5-0-0.

LEGISLATION PASSED OUT OF COMMITTEE:

  • Speaker Schultz proposed a Resolution of Appointment concerning one new Arts & Sciences Student Senator. The committee reviewed the legislation and appointment process. It was moved and seconded to recommend favorably the appointment of Randi Black as student senator for the College of Arts & Sciences and for the committee to co-author the Resolution. It was approved by a vote of 6-0-0.

GENERAL BUSINESS:

  • The spot for College of Education Student Senator was filled, but the individual backed out. They will elect someone at the council’s next meeting.
  • Proofread legislation.
  • Chair Norris provided an overview of what was discussed in a special meeting about the By-Laws and Statutes revisions.
    • The outline of the complaint process was discussed.
    • There was a consensus about the first hearing including the Elections Commissioner.
      • A formal hearing procedure must be developed for the Elections Commissioner to go through.
      • The Elections Commissioner will function as judge, so it will differ from Student Tribunal hearings.
      • Attorney General Tank provided several documents for reference in determining what the hearing would entail.
    • It was also discussed to have the Elections Commissioner and Student Tribunal not be allowed to submit a complaint. They would not be allowed to file a complaint and try that same complaint.
      • Speaker Schultz and Bill Harlan, assistant coordinator of the Office of Student Activities and Services, expressed concerns over the repercussions of that system.
      • Parliamentarian Sexton questioned whether the reporting party could abstain from the hearing if they were to report a violation.
      • Senator Muir questioned whether a person should be included whose sole responsibility would be to police violations.
      • Bill Harlan explained the process of a complaint and how it is dealt with.
      • Bill also explained his disagreement with the term hearing being applied to the initial “hearing” occurring with the Elections Commissioner.
    • Chair Norris also explained the Administration Resolution Form, provided by Attorney General Tank. It has been discussed as a potential addition to the election review process.
    • It was also considered to eliminate the difference between a major violation and minor violation.
      • Chair Norris noted discussions had included an idea to include a list of violations in the Statutes that should be considered more seriously and could be grounds for expulsion.
    • The problem with repeated offenders was also discussed and how to aid in deterrence.
    • Senator Muir noted the step below a hearing is referred to as a review.
      • There was positive reception to this opposed to a hearing.
    • Chair Norris provided tentative proposals for the entire review process to span 3 ½ days.
      • It was discussed earlier with several committee members.
      • 24 hours would be the time frame for conducting a review.
      • Candidates would have 12 hours to appeal a ruling.
      • There would then be a 48-hour period for Student Tribunal to conduct a hearing.
      • Bill Harlan noted that it might be more practical to denote actual times, because the review and appeals process would not commence at night.
      • Chair Norris also noted that the Statues do not appear to discern whether complaint violation proceedings can or cannot stretch into the weekend.
      • Bill Harlan said the judicial branch operates on weekdays.
    • The committee also reviewed the judicial branch’s appeal process.
      • Chair Norris said it would be helpful to have rules set out for an appeal.
      • Chair Norris questioned about including something about timelines.
      • Bill Harlan noted that that would be covered by the pre-existing guidelines.
      • The Student Review Board would not operate on a fact-finding basis. It would merely conduct a review with the information given to the Elections Commissioner as part of the initial “hearing” or “review.”
        • Senator Scott discussed the idea of the Elections Commissioner presenting their decision and justification to the Student Review Board as part of the appeal process.
    • Chair Norris noted the Statues state the Elections Commissioner must be appointed four weeks before the primary election.
      • The committee had previously discussed setting an approval deadline of November 1.
      • Senator Muir expressed support for setting a calendar day rather than a specific date. He proposed the first Thursday in November.
      • Bill Harlan proposed setting a deadline for names to be presented to the Operations Committee.
      • Speaker Schultz discussed setting a date for the Senate Operations to present the appointment to the Student Senate body by a certain date.
      • The third Thursday of October was proposed and received a positive reception.
      • Bill Harlan read the section of the Elections Regulations Code regarding the presentation of evidence as part of the appeal process.
    • The committee also discussed the idea of limiting the appeals to not include appealing the decision of the Student Tribunal to the university president.
    • Chair Norris noted the consensus of the committee was to not differentiate between major and minor violations but to continue doing so in regards to consequences.
      • Senator Fangman proposed referring to the violations as a Class 1 or Class 2 violation.
      • Bill Harlan said it still seemed violations were being defined as minor and major. Rather removing the section on how it is handled.
        • Senator Muir noted that wording could be included about non-negotiable sanctions.
    • Senator Scott questioned whether fines could be imposed on pairings.

    • Bill Harlan noted issues with the definition of candidates and campaign.
      • Senator Fangman proposed making the candidates responsible for their campaigns and the actions of their campaigners.
      • There was a positive reception to this idea.
      • Bill Harlan noted arguments against the idea including persons independent of the campaign hanging signs to incur violations.
    • Chair Norris discussed how the committee will be able to use a Word document to make changes to the Statutes.

      • The changes include eliminating the Election Review Committee and the position of Deputy Elections Commissioner.

      • She also made changes regarding the appointment of a new Elections Commissioner, if the Elections Commissioner resigns or cannot fulfill their duties.
      • Chair Norris proposed adding a section about Student Tribunal and how members of the Tribunal must carry out all provisions of the Elections Regulation Code.

  • There was discussion about how to present the By-Laws and Statue violations to the Student Senate body.
    • The By-Laws revisions will be presented at this week’s Senate meeting on September 10.

      • Issues with the elections commissioner and partiality towards specific candidates
      • The appeals process and elections review committee
      • Rules violations that resulted in no action by the elections review committee
    • Suggestions for restructuring the appeals process
      • Having the commissioner rule with consultation from other outside sources on any minor violations
      • Student Tribunal ruling on any major violations that occur
      • NOTE: this was suggested with the idea of dissolving the elections review committee and the elections deputy to facilitate quick decisions being made as well as having people in student tribunal who are experienced in handling legal procedure in place to review major violations
    • Providing Clarity for some of the regulations
      • Personal contributions
      • Mass distribution
      • Who is actively campaigning for a specific candidate or platform
      • What is ‘intent’ and if an action was carried out intentionally or unintentionallyduring a campaign
    • Finding qualified and unbiased members to be on the elections committee is difficult and something should be done to alleviate or make the process be conducted more fairly and effectively
  • General discussion from the committee
    • There were problems with appointing the elections commissioner
      • Because of the tight time constraints the people actually appointing the elections commissioner (Student body president, senate chair, attorney general) could have bias in who they appoint based on their own political affiliations
      • Hopefully with OPS reviewing all of the appointments due to the constitutional changes the appointment will be checked and balanced
      • Also appointing the elections commissioner should be done early to avoid any bias in the appointment and ensure that the person can plan ahead to be a neutral observer of the elections
    • The only people required to remain neutral would be the elections commissioner and members of student tribunal
    • Having a paid student employee as the elections commissioner could be an option (it could be handled like student senate secretary, appointed and then they are on the payroll of OSAS)
    • The deputy commissioner’s initial job was to look for any violations and this position was never really used to the full potential and is now completely outdated
    • Who could possibly consult with the elections commissioner on minor violations that they have to rule on:
      • Someone is OSAS
      • Student review board

      • “It is all about finding the right people”
    • Finding people to make a committee of people who can work over the summer and early next semester to really hammer things out and work out details should be a goal of OPS so that changes can be put into action for next years elections

  • Amendments to the KSU SGA Constitution
    • Name titles will changed for Student Senate Chair and Vice Chair
    • The majority of the changes will be grammatical and should not change the meaning of the document.
  • Amendments to the KSU SGA By-Laws
    • Senators to the committees will be selected by the Speaker of the Senate and the Committee Vice Chairs will now be chosen for all committees by the members of the committee.
    • Senate OPS will be the only committee changing numbers and decreasing to 5 voting members. The Secretary will now no longer be required to attend these meetings as well.
    • OPS will also have the additional role of reviewing appointments before they are presented to the full senate body.
    • There will be a new committee dealing with PR. The Speaker Pro-Tem (Vice Chair) will be the chair of this committee.
      • Will be good to coordinate community service events, monthly newsletters, and all other avenues of promoting student senate affairs.
    • Governmental Relations committee will not be limited in numbers of voting members but will have more structure in how the chair and vice chair organize.
    • Intern Program: there will be a minimum of 16 interns and a maximum of 25 interns filling the Senate Intern program throughout the year.
  • Proposed amendments to the Amendments to the Kansas State University Student Governing Association Constitution and By-Laws moved by Senator Muir and passed with a vote of 9-0-0
  • Senator Sharp moved that the Senate Operations Committee be added as authors to the Amendments to the Kansas State University Student Governing Association Constitution and By-Laws and was passed with a vote of 9-0-0.

      • Very effective in getting student senators involved with the college council
      • Have the dean and a professor who are on the council as advisors
      • Every person is put on a committee within the council to keep everyone involved and active

      • Making the meeting more informal, there is a feeling that everyone has a voice and are more engaged

      • Feel that the dean doesn’t really know what their role is in helping the student council

      • Started the semester with a social to welcome students back KSU
      • It is hard to do specific events because the college is very diverse in majors and there isn’t a main focal point
      • Always have study snacks in Eisenhower Hall during finals week for all students
      • Meeting being more structured has kind of caused a turn around in attendance
      • Feel like they are just off doing their own thing and would like to have a more regular involvement with the dean

      • Engineering Rally – kicks off the semester and welcomes the freshman
      • The career fair banquet along with the career fair to connect students to prospective employers
      • Hold a dean’s forum open to all students to hear about what is happening within the college
      • Freshman Leadership Conference (FLC) is all of the freshman involved in student council and they get their own committee and do their own projects
      • Want the student council to be a hub for all of the groups in the college
      • It is really important to have a contact list of the people in charge of the different teams and organizations in the college
