F. TERMINATION OF TENANCY PURSUANT TO THE SOLDIERS AND SAILORS RELIEF ACT OF 1940 If a tenant signs a lease before entering active military service, the tenant may terminate by sending notice after entering the service. Active military service also includes training or education under U.S. supervision preliminary to induction. Further, anyone ordered to report for induction under the Selective Training and Service Act of 1940 and any member of the enlisted Reserve Corps ordered to report for military service has the benefit of the tenancy termination portion of the Act from receipt of the order to the date of reporting for induction or service. Arguably, then, the termination notice could be sent by such individuals after receipt of the order rather than after the actual beginning of military service; however, sending the termination notice after the beginning of military service would be safer. The notice of termination should be detached at the dotted line and mailed to the landlord by certified mail, preferably return receipt requested. The receipt should be sent to the person holding the tenant's power of attorney. Such a person should also keep a copy of the tenant's notice. If a tenant's termination is not justified by the law and/or proper notice is not sent, the tenant cofor unpaid rent to the end of the term and possibly for other damages.
