A. NOTICE OF TERMINATION OF MONTH-TO-MONTH TENANCY The tenancy must terminate on a periodic rental date. The notice should be hand delivered with witnesses or sent by certified mail, return receipt requested, so that the landlord has at least thirty (30) days notice prior to a periodic rental payment date, not including the day notice is given. Thus, if rent is payable on the first, and May is the last month desired, the notice should be given on or before May 1st and should specify midnight of May 31st as the time of termination. Even though rent is paid monthly, an agreement for a term of 9 months, a year, or other specific term is NOT A MONTH-TO-MONTH TENANCY. A tenant should retain a copy of the notice sent.

NOTE: Generally all tenants in the same unit should take the same action. Since the tenants are commonly considered partners for the purpose of the lease, either all or none can terminate.
