The Shared Leave Program is a means to transfer annual and sick leave to a qualifying employee experiencing a serious, extreme or life-threatening illness, injury, impairment or physical or mental condition which has caused, or is likely to cause, the employee to take leave without pay or terminate employment, either personally or by a family member. The program provides some income protection for employees who cannot perform regular work duties and have exhausted all forms of paid leave.
Common illnesses, minor injuries, routine surgery, impairments or physical or mental conditions that are not serious, extreme, or life-threatening are excluded. Shared leave may be denied it the approving authority determines that the requesting employee has a documented history of leave abuse or unsatisfactory work attendance.
Shared Leave is meant to cover only the duration of the current illness, injury, impairment or physical or mental condition for which it was collected up to a maximum of six months from the date the employee began using Shared Leave if the employee qualifies for KPERS long-term disability payments. If the employee does not qualify for KPERS long-term disability payments after six months of Shared Leave, and the illness, injury, impairment or physical or mental condition still exists, the employee may then request more Shared Leave for up to an additional six months.
Shared Leave is paid at the receiving employee’s rate of pay by the receiving employee’s department. The receiving employee is considered on paid leave and will continue to receive benefits, as appropriate.
The receiving employee continues to accrue leave at the regular rate while on Shared Leave. Any annual and sick leave accrued each pay period must be deducted before Shared Leave credits are used.
Receiving Shared Leave is not a family status change for the KanElect flexible spending account program.
All benefits-eligible faculty and staff members, except those on a temporary appointment, are eligible to receive or donate Shared Leave after six months of continuous service with the State of Kansas. If an employee has a workers’ compensation claim for a particular medical condition they are not eligible for Shared Leave for that same medical condition. This includes receiving any workers’ compensation benefits (e.g. monetary compensation, authorized medical treatment, or a pending settlement decision from the State Self-Insurance Fund), or long-term disability, or both.
Submit a Shared Leave
Request
Form
through the employee’s department, to the Division of Human
Resources.
The request should
include as much
medical information as appropriate for the Shared Leave Review Committee
to
consider along with the request. The approving authority for Shared Leave
requests is the Provost for faculty members and the Director, Division of
Human Resources for staff members. Shared Leave decisions are not
appealable.
Faculty and staff members desiring to donate leave hours may do so only
after the requesting employee has been approved for Shared Leave. This
donation is done in writing using a Shared Leave Donation
