Three Fair Use Tests

There are three tests which can be used to help determine fair use:

Brevity: Are you using a small amount?

Spontaneity: Is it a work you suddenly decided to use for the “teachable moment” or was it an item you planned to use (or have used previously) as part of your course?

Cumulative Effect: Are you using a little bit for a very large number of people?
